Scary Statistics On Divorce

Hi there,

Almost everyone would love to know before marrying, whether or not they will end up divorced, if only to avoid the need for a prenup.  Anneli Ruffus has written a very interesting compilation of research pieces for The Daily Beast on "15 Ways to Predict Divorce."

I have always believed that parents of children with disabilities have a much higher divorce rate and now there seems to be research that indicates that parents of twins are also at risk

In addition to all the other life altering issues they face, military families have a much higher risk of divorce as well.

And finally, here is a tacky piece on the Getty divorce. The reason all of the personal financial and spending material was in the court record available for the writer to find, was that Mrs. Getty apparently was trying to set out not only his bad behavior but their lifestyle, in order to obtain the support she wanted.

Topic 9: Debts and Liabilities

Hi there,

In this unhappy recession, many folks who are getting divorced are dealing primarily with how to divide debts, but even if you are solvent you need to consider the various family liabilities out there.

You should consider who will pay the mortgages: the mortgage on the house, any equity loan or credit line, and any other mortgage on any property.  If you are on a mortgage and you will not be continuing to own the property you should arrange to have your ex take your name off the mortgage.  This will mean that he/she will need to refinance.

Safeguarding children and other thoughts

Hi there,

I have done a number of international child custody cases and one thing I know for sure is you DO NOT want your children to ever, ever be remotely involved in such a matter. If you are married, or were married to someone who holds citizenship in another country or who works abroad, this can be a concern.  I just read a terrific article in the Ohio Family Law Blog by Shawn Hooks, which gives some good information and a terrific link to help parents who might have a problem.

Also, I can't believe how convoluted family law has gotten in this transgendered age.  I was amused to read this article about Texas interpretation of gender.

And finally, in a scandal that would have resulted in political death in the U.S., the Italian prime minister is finally divorced.

A Fascinating Challenge to DOMA

Hi there,

Coming up this Thursday is the oral argument before the Federal Court in the GLAD challenge to the Federal Defense of Marriage Act.

I am someone who is strongly (fervently) in favor of gay marriage.  Single sex adoption has been around for a long time and I had thought that the successful challenge for gay marriage would come when someone argued that the adoptive children of gay parents had a right to have their parents be able to marry. 

The Goodridge Case was to me, a fair and necessary decision AND the only court decision I ever read that made me teary-eyed.  As a practitioner, I have been dealing with the unequal results of the interface between the Federal and State law ever since.  It is clearly a major issue in other states too.

The Commonwealth also has a challenge to DOMA winding its way through the Federal Court system.

I am keeping my fingers crossed!

Is Nothing Private?

Hi there,

Things have been crazy busy lately and I just had a chance to catch up on the news from a favorite site of mine, The Daily Beast.  Here are a few that I found most interesting.

I was at first astonished, and then not so surprised to learn that your credit card company can predict your coming marital woes.  When they said the husband (or wife) is the last to know, I don't think they had Visa in mind.

I am always interested in changing public (and not so public) attitudes about marriage and extramarital sex, so I was amused to read about the newest Broadway offering in this regard.  Somehow the wife doesn't seem to have been considered, nor I might add, the unnerving possibility of a divorce lawyer in their future.

And finally, another celebrity kamikaze divorce.  The McCourt's got their start in Boston and are ending on the west coast.
